General Terms and Conditions

1. Etendue Ces conditions générales (nommées dans le présent document "CG") s'appliquent à tous les services offerts par la société GET IN SHAPE Sàrl (nommée dans le présent document "GIS") et à ses membres. Le terme 'membres' désigne toute personne enregistrée comme membre après l'acceptation de nos CG. 2. Adhésion L'adhésion à GIS dure un an et débute dès l'acceptation des CG. Au terme du contrat, l'adhésion est automatiquement prolongée pour un an si aucun des deux parties ne fournit par écrit une lettre de résiliation deux mois avant son échéance. After the passing of the first year, a member obtains the right to cancel the membership at any given time, provided that he or she observes a cancellation period of two months, and announces the cancellation for the last day of the following month, delivered in written form to GIS. Une fois la première année écoulée, le membre obtient le droit de résilier son adhésion à n'importe quel instant, à condition qu'il respecte un préavis de deux mois et qu'il annonce son départ par àcrit à GIS au plus tard le dernier jour du mois. The membership fee amounts to CHF 50 (50 Swiss francs) or 30% off every contract with a customer per month. Les frais mensuels pour une adhésion sont de 50 CHF (cinquante francs suisses) ou de 30% du montant total d'un contrat avec chaque client. 3. Contacts avec les clients A GIS member is committed to show up on time as well as well groomed in front of the customers assigned to him or her by GIS. The cancellation of appointments has to be made as early as possible and in best convenience for the customer. 4. Exclusion from Liability Liability for harms done to a customer by a member of GIS (notably physical harms) cannot be assigned to GIS. 5. Professional Secrecy Members of GIS are committed to keep silent regarding all information about customers towards third parties. A third party designates all people who have not been assigned explicit access to data by GIS. 6. Quality The member has to execute the work for a customer according to the best of his or her knowledge, following the cognizance gained from his or her training. 7. Coorperation with GET IN SHAPE The success of our network is largely due to the engagement of its individual partners. We expect our members to be loyal to our network and to publish our label “GET IN SHAPE” e.g. on the personal business card or website. 8. Changes to the General Terms and Conditions GIS reserves its right to change the GTC at any given time. The changes will be communicated to members via e-mail. In the case of a change of the GTC, members are entitled to terminate their membership of GIS. The membership will be terminated with the coming into effect of the change. Already paid membership fees will not be refunded. The right to terminate the membership extinguishes at the moment when the change will come into effect. 9. Jurisdiction and Applicable Law All legal privities of contract between members and GIS are committed to Swiss law. Exclusive jurisdiction is assigned to Zurich – with reservations to deviating jurisdiction imposed by federal law.
